The current guidance was issued by the Secretary of State on 7 July 2004 and was updated on 22 June 2006 and can be downloaded (external link).  Licensing authorities must have regard to this guidance.

The guidance is provided to support and assist licensing authorities and police in implementing the 2003 Act.  The guidance is a key mechanism for promoting best practice, ensuring consistent application of licensing powers across the country and for promoting fairness, equal treatment and proportionality.

The guidance does not override licensing law or any other law.
