Car park appeal dismissed

High court dismisses appeal by car park operator

Car park owner Peter Sharma had been served an enforcement notice in December 2016 which ordered him to stop the car park operation from the site in Bedfont Road, Stanwell. The notice was served on the grounds that it was inappropriate development in the green belt.

An initial appeal against the enforcement notice was dismissed by the Planning Inspectorate, who agreed with the Council that it was inappropriate development that led to loss of openness and urban encroachment into the countryside.

Sharma then appealed against the decision of the Planning Inspectorate to the High Court.

Dismissing the challenge, Judge Andrew Grubb said the inspector had properly considered past uses of the site and given clear reasons for his conclusion that there were no 'very special circumstances' that justified the development in the green belt.

The enforcement notice was upheld.
