Council secures liability orders against two developers

The Council has secured liability orders for unpaid Community Infrastructure Levy (CIL) in two separate cases after developers failed to meet their statutory obligations and make payment, despite receiving formal reminder notices.

In the first case, relating to development at 18 Wellington Road in Ashford, Shedan North Ltd failed to submit required CIL documents and to make payment. A liability order for £29,285.10 was made on 10 February 2026, with interest continuing to accrue until paid in full.

In the second case, concerning development at 15 Station Road in Ashford, Karenor Properties Ltd also failed to follow the statutory CIL process and to make payment on time. A liability order for £55,265.85 was made on 10 February 2026, with ongoing interest also applied.

Cllr John Turner, Chair of Spelthorne Borough Council’s Environment and Sustainability Committee, said:

“CIL contributions are essential to funding local infrastructure such as roads, schools and community facilities that support new development. While we always seek to work constructively with developers, compliance with the statutory process is not optional. Where payments are not made, we will take appropriate action to recover the funds owed on behalf of our residents.”

Notes: 

CIL (Community Infrastructure Levy) is money that developers have to pay when they build new homes or commercial buildings in an area. Councils collect this money and use it to help pay for things the community needs as the area grows, such as new infrastructure and community facilities.
