Privacy Notice - Self-build and Custom Housebuilding Register

The Self-Build and Custom Housebuilding Act 2015 places a duty on councils to keep a register of individuals or groups who are interested in acquiring serviced plots of land for self-build or custom build projects in their area.  This register will provide the Council with an indication of the demand for self/custom build plots within Spelthorne.

  • Spelthorne Borough Council is the data controller for the personal data collected as part of the register.  Spelthorne Borough Council’s Data Protection Officer can be contacted at data.protection@spelthorne.gov.uk.
  • The Council is required to hold a self-build and custom housebuilding register which is a legal requirement.  As part of the register, certain personal details of applicants are required to be stored including, but not limited to, names, addresses and date of birth.
  • The personal data will be held by the Council however this may be passed onto developers or builders, if and when, a suitable serviced plot of land for development becomes available.
  • The Council will store the information for as long as a Register is required to be held, which currently is for an indefinite period, unless the applicant requests their information be removed.
  • Applicants may ask for their details to be removed from the register at any time; they may do so by emailing planning.policy@spelthorne.gov.uk
  • The Council is based in the UK and stores its data within the European Union.

The self-build and custom housebuilding register will not published and is not accessible by members of the public.  The register is held and updated by officers in the Strategic Planning team.

You have the following rights:

  • you have the right to be informed via Privacy Notices such as this,
  • you have the right to request access to and to receive a copy of any information we hold about you (including in an electronic format) - to request a copy of this information you must make a subject access request in writing,
  • if you find that the information SBC holds about you is no longer accurate, you have the right to ask to have this corrected,
  • you have the right - under certain conditions - to ask us to erase your personal data,
  • you may request that SBC stops processing your personal data in relation to any council service (this may delay or prevent us delivering a service to you, we will seek to comply with your request but may be required to hold or process information to comply with our legal duties).

You also have the right to make a complaint to the Information Commissioner's Office (ICO). This is an independent body responsible for making sure that organisations comply with Data Protection legislation.

The ICO will always expect you to have raised your concerns with us before submitting a complaint.
