Spelthorne Borough Council will be collecting personal data for the purpose of administering the CIL funding process.
In order to comply with the Data Protection Act 2018 and UK General Data Protection Regulation, Spelthorne Borough Council must provide you with the following information about the personal data you give to us:
- The Council will use the data provided to process Local and Strategic CIL funding applications which is a statutory function under the Community Infrastructure Levy Regulations 2010 (as amended)
- The lawful basis for processing this data is Legal Obligation
- The Council will be acquiring your data from your application or enquiry, we cannot process your application unless you provide this personal information
- For Local CIL funding there will be a public consultation, which is a regulatory requirement, and while your name would not be shared the name of your organisation, the project name, description, location, funding amount requested and details of any matched funding will be shared. The CIL Spending Board which considers the applications is composed of SBC Councillors who see the complete application
- For Strategic CIL funding there is no regulatory requirement upon the council to undertake public consultation. The CIL Task Group (composed of SBC Councillors and Officers) see the complete application and makes recommendations to be considered by the relevant committee (currently the Spelthorne Joint Committee) however this may change). The committee meetings are public meetings where the final decisions are made, and the papers presented include a report with the name of your organisation, the project name, description, location and funding amount requested. Note that your application form as it was submitted (which includes your personal data, and the personal data of any third parties; eg contractors), will be shared with the members of the committee however the forms will be made confidential (ie not available to the public)
- It is a regulatory requirement that for successful applications the following information is published - name of your organisation, the project name, description, location and funding amount awarded
- SBC may use images of projects resulting from award of CIL funding as part of publicity material
- The Council will keep your data indefinitely due to requirements relating to future responsibilities / covenants on land

The Council has a duty to comply with FOI / EIR requests as we are a public authority so there may be instances where we are obliged to share information relating to your application.

- you have the right to request access to and to receive a copy of any information we hold about you (including in an electronic format) - to request a copy of this information you must make a subject access request in writing
- if you find that the information Spelthorne Borough Council holds about you is no longer accurate, you have the right to ask to have this corrected
- you have the right - under certain conditions - to ask us to erase your personal data
- you may request that Spelthorne Borough Council stops processing your personal data in relation to any council service (this may delay or prevent us delivering a service to you, we will seek to comply with your request but may be required to hold or process information to comply with our legal duties)

You also have the right to make a complaint to the Information Commissioner's Office (ICO). This is an independent body responsible for making sure that organisations comply with Data Protection legislation.
