Privacy Notice - Community Safety Consultation

In order to comply with the Data Protection Act and the UK General Data Protection Regulation, Spelthorne Borough Council must provide individuals with various information about the personal data collected by the council:

Spelthorne Borough Council will collect and process the following information when we are contacted to report a concern or an incident. 

  • Identity data [name, address and contact details]
  • Incident details [details of any incident you were a witness to or victim of]

We collect and process the following information about an alleged perpetrator of crime or anti-social behaviour.

  • Identity data [name, address and contact details]
  • Biographical information [date and place of birth, marriage status, gender]
  • Payment details [payment card data and payments from you]
  • Cultural background [nationality, ethnicity and race]
  • Criminal background [criminal convictions or criminal behaviour]
  • Immigration status [right to live and work in the UK]
  • Health information [medical conditions and disabilities]
  • Physical appearance [descriptions and photographs]

We collect this information in a variety of ways.

The lawful basis for processing this information is Public task - we need to collect or use your information to carry out a task laid down in law, which the law intends to be performed by an organisation such as ours. Specifically, we have a duty to help prevent and reduce crime and anti-social behaviour under the Crime & Disorder Act 1998 and tools and powers to act under the Anti Social Behaviour Crime and Policing Act 2014. 

Special category personal data is processed because it is a necessary function conferred on us by an enactment or rule of law or because we have a duty to prevent or detect an unlawful act.

Your information may be shared with other third parties within the Council and externally such as the Police and Probation Service if appropriate. We may also need to share the information provided with other organisations who are in the Surrey Multi-Agency Information Sharing Protocol Agreement. 

The Crime and Disorder Act 1998 introduced a statutory requirement that key local agencies work together in partnership to tackle crime and disorder in their localities, Spelthorne Borough Council is part of the Community Harm and Risk Management Meeting (CHaRMM) partnership and shares information using the Empowering Communities Integrated Network System (ECINS) this is a secure, encrypted hub where all the partners share timely and efficient information on joint cases for the reduction of crime, disorder and anti-social behaviour. 

The Council will keep your data for a maximum of 7 years after the last action.

You have the following rights:

  • you have the right to be informed via Privacy Notices such as this,
  • you have the right to request access to and to receive a copy of any information we hold about you (including in an electronic format) - to request a copy of this information you must make a subject access request in writing,
  • if you find that the information Spelthorne Borough Council holds about you is no longer accurate, you have the right to ask to have this corrected,
  • you have the right - under certain conditions - to ask us to erase your personal data,
  • you may request that Spelthorne Borough Council stops processing your personal data in relation to any council service (this may delay or prevent us delivering a service to you, we will seek to comply with your request but may be required to hold or process information to comply with our legal duties).

You also have the right to make a complaint to the Information Commissioner's Office (ICO). This is an independent body responsible for making sure that organisations comply with Data Protection legislation.

The ICO will always expect you to have raised your concerns with us before submitting a complaint.
