Privacy Notice - Flood Recovery Grants for Storm Henk

In the current circumstances we may make changes to this privacy notice and so would encourage you to check it from time to time.

In order to comply with the Data Protection Act and General Data Protection Regulation, Spelthorne Borough Council, Knowle Green, Staines upon Thames, TW18 1XB must provide you with the following information about the personal data you give to us:

This notice applies to potential, current and former customers of the service and those we have contacted but have opted not to partake in the service.

The Council is the data controller for the data provided and will use the data for the following purposes:

  • determining whether you qualify for financial assistance under the Flood Recovery Framework or Community Recovery Grant or Council Tax discounts
  • determining whether you qualify for financial assistance under the Business Rates Relief or Business Recovery Grant or Property Flood Resilience Scheme
  • for making payment of your financial entitlement under the Scheme

We will be processing your data under Public Task. If you do not provide the information, we will not be able to process your application.

Your personal data will be processed for this purpose, although your details may be shared between Council departments and other agencies where there is lawful basis to do so.

For the purposes of processing payments your data will be shared with Spelthorne Borough Council finance.

Your relevant data may be entered into systems owned by Department of Levelling Up, Housing and Communities, Department for Business and Trade, Department for Environment, Food and Rural Affairs as part of the process for assessing your eligibility.  Other checks for eligibility may be made by use of information held within Council Tax and Business Rates departments. The council may check the information you provide against the records that are held by the other authorities.

In cases of suspected fraud your data may be passed to the police to conduct an investigation.  We may also share your data if we are required to do so by law, for example by court order or to prevent fraud or other crime.

The Council will keep your data for a maximum of 7 years after the date of our last contact with you.

You have the following rights:

  • you have the right to be informed via Privacy Notices such as this
  • you have the right to request access to and to receive a copy of any information we hold about you (including in an electronic format) - to request a copy of this information you must make a subject access request in writing
  • if you find that the information SBC holds about you is no longer accurate, you have the right to ask to have this corrected
  • you have the right - under certain conditions - to ask us to erase your personal data
  • you may request that SBC stops processing your personal data in relation to any council service (this may delay or prevent us delivering a service to you, we will seek to comply with your request but may be required to hold or process information to comply with our legal duties)

You also have the right to make a complaint to the Information Commissioner's Office (ICO). This is an independent body responsible for making sure that organisations comply with Data Protection legislation.

The ICO will always expect you to have raised your concerns with us before submitting a complaint.
