Privacy Notice - Waste and recycling services

Spelthorne Borough Council will be collecting your data to run our waste and recycling services.

In order to comply with the Data Protection Act and General Data Protection Regulation, Spelthorne Borough Council must provide you with the following information about the personal data you give to us:

  • depending on the service we may collect and process the following information:
    • name
    • address
    • contact information (telephone numbers and email address)
  • the council does not need, and does not use, information about you for routine bin collections. Information about you will only be used if you:
    • report a missed collection
    • if a resident disputes non collection due to non-conforming waste being present then additional information may be collected which may result in an Officer visiting the property to further inspect the bin and offer information about the cause of non-collection
    • order new, additional or replacement waste and recycling containers
    • report missing or damaged containers
    • request a collection of a bulky item
    • apply for an assisted collection
    • make a general service enquiry, comment or complaint
  • the Council will use the data provided under the lawful basis of "public task"
  • your information may be shared with other internal departments to help maintain the running of the service
  • your information may be shared with our partner organisation Joint Waste Solutions.  We will only share the minimum amount of data required for the purpose of the sharing
  • your address information will be shared with the Bartec Vehicle System in order to track and monitor our trucks and your collections, but will not be used for any other purposes
  • sometimes it may be necessary to share your information without your permission, e.g. for the detection or prevention of crime or if the sharing would help with a safeguarding issue. The Council will never sell your information to anyone else
  • the Council will keep your data for a maximum of 6 years post termination of the service as detailed in the Council's retention policy

Further information

You have the following rights:

  • you have the right to be informed via Privacy Notices such as this,
  • you have the right to request access to and to receive a copy of any information we hold about you (including in an electronic format) - to request a copy of this information you must make a subject access request in writing,
  • if you find that the information Spelthorne Borough Council holds about you is no longer accurate, you have the right to ask to have this corrected,
  • you have the right - under certain conditions - to ask us to erase your personal data,
  • you may request that Spelthorne Borough Council stops processing your personal data in relation to any council service (this may delay or prevent us delivering a service to you, we will seek to comply with your request but may be required to hold or process information to comply with our legal duties).

You also have the right to make a complaint to the Information Commissioner's Office (ICO). This is an independent body responsible for making sure that organisations comply with Data Protection legislation.

The ICO will always expect you to have raised your concerns with us before submitting a complaint.
