Privacy Notice Cemeteries

Spelthorne Borough Council, Whitehouse Depot, Kingston Road, Ashford, TW15 3SE, will be collecting your name and address for the Burial Records. The records are used to ensure only owners of Exclusive Right of Burials (EROB) can give permission for burials and any work on cemetery plots.

In order to comply with the Data Protection Act 2018 and General Data Protection Regulation, Spelthorne Borough Council must provide you with the following information:

  • The Council will use the data provided to confirm the owners of EROBs with Funeral Directors and Memorial Masons as we have a legal obligation to do so under the Local Authorities Cemeteries Act 1977.
  • The Council has acquired your data from a Funeral Director or the person(s) applying for a transfer of EROB.
  • Your information will be shared with Funeral Directors and Memorial Masons if they request the information.  The Council is obliged to do this by the Local Authorities Cemetery Act 1977.
  • The ownership of the graves' information will be shared with the funeral directors and memorial masons in order for them to carry out their duties.
  • Your data will not be shared outside the EU or be subject to any automated decision-making.
  • The Council will keep your data for their Burial records in perpetuity (125 years) as indicated by law. Written records will be kept for 6 years and then destroyed.
  • We have a legal requirement to collect this data, therefore if you do not provide this data to the Council you may not be able to carry out any further interments or work on a plot in your ownership.

You have the following rights:

  • you have the right to be informed via Privacy Notices such as this,
  • you have the right to request access to and to receive a copy of any information we hold about you (including in an electronic format) - to request a copy of this information you must make a subject access request in writing,
  • if you find that the information Spelthorne Borough Council holds about you is no longer accurate, you have the right to ask to have this corrected,
  • you have the right - under certain conditions - to ask us to erase your personal data,
  • you may request that Spelthorne Borough Council stops processing your personal data in relation to any council service (this may delay or prevent us delivering a service to you, we will seek to comply with your request but may be required to hold or process information to comply with our legal duties).

You also have the right to make a complaint to the Information Commissioner's Office (ICO). This is an independent body responsible for making sure that organisations comply with Data Protection legislation.
